Nexian Realty LLC ("Nexian Realty," "we," "us," or "our") respects your privacy and is committed to protecting the personal information you share with us. This Privacy Policy explains what information we collect, how we use it, how we protect it, and the choices you have.

It applies to nexianrealty.com and all of its subdomains — including offmarket.nexianrealty.com — together with any communications, forms, chat widgets, or messaging programs we operate (collectively, the "Site").

By using the Site or providing us your information, you agree to the practices described in this Policy.

1. Who We Are

Nexian Realty LLC is a licensed real estate brokerage operating in the Commonwealth of Kentucky.

2. Information We Collect

We collect information you provide directly and information collected automatically when you use the Site.

Information you provide may include your name, email address, mailing address, phone number, property address, property interests, and any details you submit through contact forms, lead forms, the website chat widget, or when you request information about buying, selling, or investing in real estate.

Information collected automatically may include your IP address, browser type, device information, pages visited, referring URLs, campaign and referral parameters, and similar usage data collected through cookies and comparable technologies described in Section 5.

3. How We Use Your Information

We use your information to:

  • Respond to your inquiries and provide the real estate services you request;
  • Contact you about properties, listings, and services relevant to your stated interests;
  • Send you transactional and, with your consent, marketing communications by email, phone, or SMS text message;
  • Measure and improve our marketing, including which campaigns bring people to the Site;
  • Operate, improve, and secure the Site; and
  • Comply with applicable legal and regulatory obligations.

4. How We Share Your Information

We may share your information with trusted service providers who perform functions on our behalf (for example, hosting, analytics, CRM, marketing-automation, and communications platforms), and only to the extent necessary for them to provide those services. We may also disclose information when required by law or to protect our legal rights.

We do not sell your personal information.

5. Cookies, Analytics, and Session Recording

The Site uses cookies and similar technologies to operate the Site, remember your preferences, and analyze usage. We also use third-party analytics services that may record how visitors interact with our pages — including scrolling, clicks, and navigation — so that we can understand how the Site is used and improve it.

The services we currently use for this purpose are:

  • Microsoft Clarity — usage analytics and session recording. Text entered into form fields is masked and is not captured by the recording.
  • Ahrefs Analytics — aggregate traffic and referral measurement.
  • Cloudflare — hosting, security, and aggregate performance measurement.

You can control cookies through your browser settings; disabling them may affect Site functionality.

6. SMS / Text Messaging Program and Mobile Consent

If you opt in to receive text messages from Nexian Realty LLC — for example, by checking the SMS consent box on our website chat widget or a contact form, or by otherwise providing your mobile number and agreeing to be contacted by text — the following applies:

  • Consent is not a condition of purchase. You are not required to agree to receive texts in order to buy, sell, or use any Nexian Realty service.
  • Program description. We may send you messages related to your inquiry, appointment scheduling, property updates, follow-ups, and account or transaction notifications.
  • Message frequency varies based on your interaction with us.
  • Message and data rates may apply. Contact your wireless carrier for details of your plan.
  • Opt out at any time by replying STOP to any message. You will receive a one-time confirmation and will not receive further messages unless you opt in again.

  • Carriers are not liable for delayed or undelivered messages.

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. All of the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties. Information you provide as part of the SMS program is used solely by Nexian Realty LLC to deliver the messaging service you requested.

7. Your Choices and Your Rights

You may opt out of marketing emails using the unsubscribe link in any email, and opt out of texts by replying STOP.

You may also request access to, correction of, or deletion of your personal information, and ask us to stop using it for targeted advertising, by contacting us at hello@nexianrealty.com. We will respond consistent with applicable law. If we decline a request, we will tell you why and how to appeal that decision.

8. Data Security

We use reasonable administrative, technical, and physical safeguards designed to protect your personal information. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

9. Children's Privacy

The Site is not directed to children under 18, and we do not knowingly collect personal information from children.

We may update this Policy from time to time. The "Last Updated" date above reflects the most recent revision. Material changes will be posted on this page.
